Atomic Training Terms and Conditions

Welcome to Atomic Training.

At Atomic Training, we believe that long-term success is built through consistency, accountability and continuous improvement. This Client Agreement outlines the terms that govern our coaching relationship and ensures clear expectations for both you and your coach.

By engaging in any Atomic Training service, you acknowledge that you have read, understood and agree to the terms contained within this agreement.

1. Services

Atomic Training provides personalised coaching services including, but not limited to:

  • Face-to-Face Personal Training

  • Small Group Personal Training

  • Online Coaching

  • Personalised Training Programs

  • Exercise Programming

  • Lifestyle and Accountability Coaching

All coaching is tailored to the individual using evidence-based training principles and designed to support long-term progress.

2. Payments

All services must be paid in accordance with the agreed pricing and payment schedule.

Ongoing coaching services operate via recurring direct debit or another approved payment method.

If a scheduled payment cannot be processed, Atomic Training reserves the right to suspend coaching services until the account has been brought up to date.

Atomic Training reserves the right to amend pricing in the future. Clients will receive reasonable notice of any pricing changes before they take effect.

3. In-Person Session Cancellation Policy

Face-to-Face Personal Training and Small Group Personal Training sessions require a minimum of 24 hours' notice to cancel or reschedule.

Sessions cancelled with less than 24 hours' notice, or missed without notice, will be charged in full.

Exceptional Circumstances

Atomic Training understands that genuine emergencies can occur.

In exceptional circumstances such as:

  • Serious injury

  • Hospitalisation

  • Severe motor vehicle accident

  • Other significant unforeseen emergencies

the cancellation fee may be waived at the discretion of your coach.

General illness (including waking up unwell, cold or flu symptoms, sore throat or food poisoning) does not automatically exempt a client from this cancellation policy.

Any waiver of cancellation fees remains entirely at the discretion of Atomic Training.

4. Online Coaching Cancellation Policy

Online Coaching operates on a recurring weekly payment schedule unless otherwise agreed.

If you wish to cancel your Online Coaching membership, a minimum of 14 days' written notice must be provided via email or text message.

During the notice period, coaching services will continue as normal, including:

  • Personalised programming

  • Program updates

  • Communication

  • Accountability

  • Ongoing coaching support

Payments scheduled during the notice period will continue to be processed.

Payments already processed are non-refundable.

5. Client Responsibilities

To maximise your results, you agree to:

  • Attend scheduled sessions on time.

  • Complete all health screening forms honestly.

  • Inform your coach of any injuries, illnesses or changes to your health.

  • Follow coaching advice responsibly.

  • Log training sessions accurately where applicable.

  • Communicate openly regarding your goals, progress and concerns.

  • Treat coaches, staff and other members with respect.

6. Coach Responsibilities

Atomic Training is committed to providing:

  • Individualised coaching.

  • Evidence-based programming.

  • Ongoing accountability and support.

  • Regular review and adjustment of training programs.

  • Professional conduct at all times.

  • Respectful and confidential handling of client information.

7. Communication

Clients may contact their coach via the agreed communication channels (such as TrainHeroic, email or text message).

Atomic Training aims to respond promptly; however, responses are generally provided during normal business hours and may take up to 24–48 hours.

Online Coaching includes ongoing communication and support but does not include unlimited or immediate access to your coach.

8. Program Delivery

Every training program is designed specifically for the individual based on their goals, experience, training history and current circumstances.

Programs are reviewed and updated when appropriate to ensure coaching decisions are based on your progress rather than fixed timelines.

Clients are encouraged to complete sessions consistently and provide regular feedback to allow for the most effective coaching decisions.

9. Health & Safety

Participation in exercise carries inherent risks.

By participating in Atomic Training services, you acknowledge these risks and agree to participate voluntarily.

You agree to:

  • Exercise within your capabilities.

  • Follow coaching instructions.

  • Immediately notify your coach if you experience pain, dizziness or unusual symptoms.

  • Obtain appropriate medical clearance where required.

Atomic Training is not responsible for injuries resulting from failure to disclose relevant medical information or failure to follow coaching advice.

10. Results Disclaimer

Atomic Training provides professional coaching based on current evidence and best practice.

While every effort is made to help clients achieve their goals, individual results cannot be guaranteed.

Progress is influenced by many factors, including:

  • Consistency

  • Effort

  • Nutrition

  • Recovery

  • Sleep

  • Lifestyle

  • Adherence to the prescribed program

  • Individual physiology

Ultimately, your results depend on your commitment to the coaching process.

11. Refund Policy

Payments are generally non-refundable once coaching services have commenced.

Refunds will only be provided where required under Australian Consumer Law.

Unused coaching services or sessions are not eligible for refund unless otherwise agreed by Atomic Training.

12. Suspension of Coaching

Coaching may be temporarily suspended in circumstances such as:

  • Significant injury

  • Extended travel

  • Pregnancy

  • Exceptional personal circumstances

Any suspension must be approved by Atomic Training and will be considered on a case-by-case basis.

13. Intellectual Property

All training programs, exercise videos, educational resources, coaching materials and supporting content provided by Atomic Training remain the intellectual property of Atomic Training.

These materials are provided solely for your personal use.

They may not be copied, reproduced, distributed, shared, sold or used for commercial purposes without prior written permission.

14. Media Consent

From time to time, Atomic Training may take photographs or videos during training sessions for educational, promotional or social media purposes.

No identifiable images or videos of clients will be published without prior consent.

Consent may be withdrawn at any time by notifying Atomic Training in writing.

15. Limitation of Liability

To the maximum extent permitted by law, Atomic Training shall not be liable for any injury, illness, loss or damage arising from participation in coaching services, except where liability cannot legally be excluded.

Nothing in this agreement excludes or limits any rights available under Australian Consumer Law.

16. Client Conduct

Atomic Training is committed to maintaining a respectful, safe and supportive training environment.

Clients are expected to:

  • Treat coaches and fellow members respectfully.

  • Use equipment responsibly.

  • Follow all reasonable coaching instructions.

  • Behave in a manner that contributes positively to the training environment.

Atomic Training reserves the right to refuse or terminate coaching services where a client's behaviour is unsafe, abusive, threatening or repeatedly disruptive.

17. Suspension or Termination of Services

Either the client or Atomic Training may end the coaching relationship at any time, subject to the applicable cancellation or notice requirements.

Atomic Training reserves the right to immediately suspend or terminate services where a client:

  • Repeatedly breaches this agreement.

  • Engages in abusive, threatening or inappropriate behaviour.

  • Places themselves or others at risk.

  • Repeatedly fails to meet payment obligations.

Outstanding fees remain payable where applicable.

18. Force Majeure

Atomic Training shall not be considered in breach of this agreement where coaching services are interrupted due to circumstances beyond reasonable control, including natural disasters, government restrictions, pandemics, facility closures, power outages or other unforeseen events.

Where practical, reasonable alternative coaching arrangements will be offered.

19. Privacy

Atomic Training respects your privacy.

Personal information collected throughout your coaching journey is used solely for the purpose of delivering coaching services, maintaining client records and communicating with you.

Your information will not be disclosed to third parties except where required by law or with your consent.

20. Changes to this Agreement

Atomic Training reserves the right to amend this Client Agreement from time to time.

Clients will be provided with reasonable notice of any significant changes before those changes take effect.

21. Governing Law

This agreement is governed by the laws of Queensland, Australia.

Any disputes arising under this agreement shall be subject to the jurisdiction of the courts of Queensland.

Client Declaration

By engaging in any Atomic Training service, I acknowledge that:

  • I have read and understood this Client Agreement.

  • I have had the opportunity to ask questions before commencing coaching.

  • I understand the risks associated with exercise.

  • I voluntarily agree to participate in coaching services.

  • I agree to abide by the terms outlined in this agreement.
